Terms & Conditions of Service

1. Acceptance of Terms

By accessing or using the Wabisabi application, the website located at https://wabisabi.fashion, related APIs, or associated services (collectively, the "Services"), you confirm that you have read, understood, and agreed to be bound by these Terms and Conditions ("Terms"), as well as our Privacy Policy.

If you do not agree with any part of these Terms, you must discontinue all access to and use of our Services immediately.

2. Eligibility & Account Registration

You must be at least 13 years of age (or 16 years of age in the European Economic Area / United Kingdom) to create a Wabisabi account. If you are under the age of majority in your jurisdiction, you represent that you have obtained consent from a parent or legal guardian.

Account Security & Social Connect

You may register via One-Tap Social Authentication (Google OAuth, Instagram OAuth, TikTok Login Kit) or via phone number verification with a One-Time Password (OTP). You agree to:

• Provide accurate, current, and complete account details during onboarding.
• Maintain the confidentiality of your authentication credentials and linked devices.
• Promptly notify us at support@wabisabi.fashion upon detecting any unauthorized access or breach of security.

3. Description of Services

Wabisabi provides a comprehensive fashion, beauty, and wellness inventory and context-aware styling platform. Key modules include:

1. Digital Closet & Vanity: Digitization of apparel, cosmetics, skincare finishes, hairstyles, and fragrances with automated background removal and metadata auto-tagging.
2. Context-Aware Styling Engine: Recommendations combining your wardrobe items, calendar agendas, real-time location weather metrics, and venue environment settings.
3. Photorealistic AI Virtual Try-On: Multimodal neural rendering of outfit combinations mapped onto your uploaded reference photograph.
4. Cost-Per-Wear (CPW) Analytics: Wear count tracking, utilization insights, and mindful wardrobe reporting.

4. User Content & Photo Uploads

To use our virtual try-on and inventory features, you may upload photos of clothing, beauty products, and a full-body reference photograph ("User Content").

Ownership of Your Images

You retain 100% full ownership, copyright, and title to all photographs and images you upload to Wabisabi.

Limited License to Wabisabi

By uploading User Content, you grant Wabisabi a strictly limited, non-exclusive, revocable, royalty-free license solely to host, process, segment, and render such images for the explicit purpose of providing styling recommendations and virtual try-ons to you. We do not sell your personal photographs or license them to external data brokers.

Content Warranties

You warrant that:

• You own or possess the necessary rights and consents to upload the photos.
• Any full-body reference image uploaded is of yourself, or of an individual from whom you have received explicit, verifiable written consent.
• Your uploads do not contain nudity, sexually explicit content, violence, or content that infringes upon third-party rights.

5. AI Technology & Styling Disclaimers

Wabisabi utilizes generative machine learning and computer vision pipelines (including Google Cloud Vertex AI and Nanobanana diffusion models) to create outfit visualizations and style suggestions.

Informational & Stylistic Purpose

AI recommendations, color harmonies, and virtual try-on imagery are algorithmic approximations provided for aesthetic inspiration and convenience. Fabric drape, fit fidelity, and shade matches on physical garments may differ from virtual renders.

No Professional Medical or Dermatological Advice

Suggestions concerning skincare finishes, UV protection, or hair routines do not constitute medical, dermatological, or healthcare advice. Always consult certified dermatologists or healthcare professionals regarding allergies, skin sensitivities, or medical conditions.

6. Subscriptions, In-App Purchases & Tokens

Wabisabi offers both free tier access and paid premium services:

• Free Tier: Includes up to 30 vault items, basic mix-and-match logic, and 5 complimentary style tokens.
• Wabisabi Basic: USD 5.00 per month, providing unlimited inventory storage and 10 monthly AI recommendations.
• Wabisabi Pro: USD 8.00 per month, unlocking priority generation speed, advanced CPW analytics, and expanded styling tokens.
• Token Top-Ups: Additional styling tokens are available at USD 3.00 per 10 tokens. Tokens do not expire while your account remains active.

Billing & Automatic Renewal

Subscriptions are billed on a recurring monthly or annual basis via Apple App Store, Google Play Store, or authorized payment processors. Unless canceled at least 24 hours prior to the conclusion of the current billing cycle, subscriptions renew automatically. You may cancel renewal at any time through your device's subscription management settings.

Refund Policy

Subscription payments and consumed tokens are non-refundable, except where mandatory consumer protection laws in your jurisdiction dictate otherwise. Inquiries may be directed to billing@wabisabi.fashion.

7. Acceptable Use & Prohibited Conduct

You agree not to misuse Wabisabi or assist any third party in doing so. You shall not:

• Reverse engineer, decompile, or extract the source code or proprietary styling algorithms of Wabisabi.
• Upload images of other individuals without their express permission or submit non-consensual imagery.
• Use automated scripts, bots, scrapers, or spiders to harvest data from wabisabi.fashion.
• Interfere with or disrupt the security or integrity of our servers or Google Cloud infrastructure.
• Circumvent subscription caps, freemium inventory limits, or token balances through unauthorized means.

8. Intellectual Property

The Wabisabi brand name, the Ensō logo mark (Logo 2), taglines ("Ease in your truth", "The beauty of imperfection"), application UI designs, animations, software code, and documentation are the exclusive intellectual property of Wabisabi Fashion Inc. All rights not expressly granted herein are reserved.

9. Account Termination & Deletion

You may terminate your account at any time directly through the app settings or by submitting a deletion request to privacy@wabisabi.fashion. Upon confirmation, your full-body reference photos, digital closet images, and personal profile data will be permanently purged from our active storage buckets within thirty (30) days, in accordance with our Privacy Policy.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraud, or abuse our infrastructure.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, WABISABI DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WABISABI AND ITS DIRECTORS, EMPLOYEES, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO WABISABI IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Malaysia (and applicable international conventions), without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms shall first be addressed through good-faith informal negotiations. If unresolved within 30 days, disputes shall be submitted to confidential binding arbitration.
